General Terms and Conditions of Business for booking Academy events

The following T&C shall govern the contractual relationship between the participant attending conferences, seminars and workshops (hereinafter “event”) and Staufen AG Consulting Academy Investment (hereinafter “Staufen”).

Registration/Confirmation of Registration

Registering for an event shall normally be made in writing, either via the Internet or by letter, fax or email.
Our written confirmation (letter, fax or email) shall make registration legally binding.
Because attendance numbers are limited, particularly for event components such as company visits and similar, registrations shall be considered according to the date of receipt.
There is no general entitlement to attend an event; the organiser reserves the right to allow attendance on an individual basis.

Service Provision

The cost is per person and event date subject to VAT at the prevailing rate. The cost includes conference documents, lunch and refreshments.
Staufen reserves the right to replace advertised speakers and to make alterations to the event programme while adhering to the overall character of the event.
Participants shall be notified immediately if the event cannot take place as a result of force majeure, if a speaker is unable to attend, or if there are difficulties and problems at the venue or insufficient participant numbers. If an event is cancelled because of insufficient numbers, participants shall be notified no later than 2 weeks before the event. A claim for reimbursement of travel and accommodation expenses and non-productive time is excluded unless such expenses arise as a result of grossly negligent or wilful conduct on the part of Staufen. In the case of any disruption to service provision, Staufen shall undertake to rectify or limit the disruption to a reasonable extent.

Travel/Overnight Accommodation

The participant shall arrange/book and pay for his/her own travel and overnight accommodation. Preferential rates may in some cases be available for accommodation (hotels) as advertised by Staufen where room bookings are made in good time. Further details can be found in the confirmation of registration.

Due Date and Payment, Delay, Offsetting

The amount due for the event must be settled within 14 days of receipt of invoice. If payment is late, Staufen is entitled to request late payment interest of 5% above the base interest rate as set by the European Central Bank (section 247, para. 1 of the German Civil Code (Bürgerliches Gesetzbuch, abbr. BGB)). Staufen may assert higher damages where provable for late payment.

Cancellation

Bookings may be cancelled free of charge up to 14 days before the event start date; the total amount due shall be payable if bookings are cancelled less than 14 days before the event start date, including in cases where participants fail to attend or cancel their booking on the day of the event. Cancellations are to be made in writing and shall only become effective when the organiser gives written confirmation of cancellation.
Staufen gladly accepts a replacement participant at no additional cost.

The organiser reserves the right to move the whole event or individual parts thereof to another location and/or time, to make alterations or to cancel the event at short notice. If the event is cancelled outright (excluding force majeure) and if any fees have already been paid, these shall be refunded or alternatively a guest card (credit note) issued.
Further claims are excluded unless they are based on wilful or grossly negligent conduct on the part of Staufen employees or any other performing agents.

Copyrights

Conference documents are protected by copyright. The reproduction, transmission or any other use of conference documents is only permitted with the express written consent of Staufen.
Filming, sound recording and photography are not permitted during the event.
The organiser assumes no responsibility or liability whatsoever for any inaccuracy relating to the content of presentations and documentation.

Liability

Where events take place in locations and on properties owned by third parties, the event organiser shall not be liable for any accidents and loss or damage to property belonging to participants unless the damage caused stems from wilful or grossly negligent conduct on the part of Staufen employees or any other performing agents.

Applicable Law, Place of Jurisdiction and Place of Fulfilment

German law shall apply to the exclusion of the UN Convention on the International Sale of Goods (CISG). It is agreed that Stuttgart, Federal Republic of Germany, shall be the place of fulfilment and place of jurisdiction where permitted by law.

Data Protection

Personal data shall be processed and used by Staufen. Staufen shall not pass on or allow third parties to view such data.
